Welcome to Old Pueblo Tai Chi ("we," "us," or "our"). By accessing or using our websites oldpueblotaichi.com and blog.oldpueblotaichi.com (collectively, the "Site") or participating in our classes and services, you agree to these Terms of Service ("Terms").

1. Acceptance of Terms

By using the Site or participating in our classes, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site or our services.

2. Services Provided

Old Pueblo Tai Chi offers Tai Chi and Qigong instruction, classes, workshops, and related wellness services. All services are provided for educational and wellness purposes only and are not intended as medical advice, diagnosis, or treatment.

3. Eligibility and Age Requirement

Our classes are designed for adults 18 years of age and older. By registering for classes, you represent that you are at least 18 years old.

4. Registration and Payment

Drop-In Classes: Payment of $12 per class is due at the time of attendance. Payment can be made online or in person (cash or check accepted).

Monthly Pass: Monthly passes are $40 and provide unlimited access to classes for the calendar month. Monthly passes auto-renew unless cancelled. You may cancel at any time by contacting us at oldpueblotaichi@gmail.com.

Payment Processing: Online payments are processed securely through Stripe. We do not store your full payment card information.

5. Cancellation and Refund Policy

Drop-In Classes: No refunds for drop-in classes once payment is made.

Monthly Pass: Monthly passes are valid for the calendar month and are non-refundable. However, we understand that circumstances arise and will work with you on a case-by-case basis.

Class Cancellations: We reserve the right to cancel classes due to weather, instructor illness, or other unforeseen circumstances. In such cases, we will provide notice via email and offer make-up classes or credits.

6. Health and Safety

Medical Consultation: You are strongly advised to consult with your physician before beginning any new exercise program, including Tai Chi and Qigong.

Assumption of Risk: Participation in physical activities involves inherent risks. By participating, you acknowledge and accept these risks. Please see our Liability Waiver for complete details.

Injuries: If you experience any pain, discomfort, or injury during class, stop immediately and inform the instructor.

7. Conduct and Participation

We maintain a welcoming, respectful, and inclusive environment. Disruptive, disrespectful, or unsafe behavior may result in removal from class without refund.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and downloadable materials, is owned by Old Pueblo Tai Chi or licensed to us and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

9. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

  • Use the Site in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Site
  • Interfere with or disrupt the Site's functionality
  • Transmit viruses, malware, or other harmful code
  • Collect or harvest information about other users

10. Third-Party Services and Links

The Site may contain links to third-party websites or services (such as Stripe for payments, Mailchimp for email, Google Analytics for site analytics). We are not responsible for the content, privacy practices, or terms of service of these third parties.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

12. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OLD PUEBLO TAI CHI, DAN KIMBALL, PATH4CHANGE PLLC, AND THEIR RESPECTIVE AGENTS, EMPLOYEES, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SITE OR SERVICES.

14. Indemnification

You agree to indemnify, defend, and hold harmless Old Pueblo Tai Chi, Dan Kimball, Path4Change PLLC, and their respective agents, employees, and representatives from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Site or services, your violation of these Terms, or your violation of any rights of another.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated Effective Date. Your continued use of the Site or services after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts located in Pima County, Arizona.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
