Please read this waiver carefully before participating in Tai Chi and Qigong classes with Old Pueblo Tai Chi.
I understand that my participation in Tai Chi and Qigong classes offered by Dan Kimball and Old Pueblo Tai Chi is entirely voluntary. I am participating in these activities of my own free will.
I acknowledge that I have been advised to consult with a physician before beginning any new exercise program, including Tai Chi and Qigong. I understand that it is my responsibility to consult with my healthcare provider regarding my fitness to participate in these activities.
I understand that physical exercise and movement activities, including Tai Chi and Qigong, involve certain inherent risks including but not limited to: muscle strain, joint injury, falls, and other bodily harm. I voluntarily assume all risks associated with my participation in these classes.
I understand that Dan Kimball is a Tai Chi and Qigong instructor, and that the instruction provided is for educational and wellness purposes only. The classes are not intended as medical advice, diagnosis, or treatment. No therapeutic relationship is established through my participation in these classes.
In consideration of being allowed to participate in Tai Chi and Qigong classes, I hereby release, waive, discharge, and covenant not to sue Dan Kimball, Old Pueblo Tai Chi, Path4Change PLLC, and their respective agents, employees, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in such activities, whether caused by the ordinary negligence of the releasees or otherwise.
I also release and hold harmless the facilities where classes are held, including Culture Connects Studio, from any liability related to my participation in classes at their location.
I agree to indemnify and hold harmless the parties mentioned above from any loss, liability, damage, or costs they may incur arising out of or related to my participation in these activities.
I authorize Dan Kimball and his representatives to seek emergency medical treatment for me if necessary, and I agree to be financially responsible for any costs incurred as a result of such treatment.
I understand that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
I have read this waiver of liability, assumption of risk, and release agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
By participating in Old Pueblo Tai Chi classes, you acknowledge that you have read, understood, and agree to the terms of this waiver and release agreement, and that you are 18 years of age or older.
